Welcome to LowRenta ("Company", "we", "us", "our"). These Terms of Service ("Terms") govern your access to and use of lowrenta.com, including the LowRenta Pro platform and any related services (collectively, the "Service"). By accessing or using the Service, you agree to be bound by these Terms.
By creating an account, subscribing, or using the Service, you confirm that you: (a) are at least 18 years old; (b) have read and agree to these Terms and our Privacy Policy; (c) if acting on behalf of a business, have authority to bind that entity.
LowRenta provides a commercial real estate search and lead-management platform for licensed real estate professionals and their clients. The Service aggregates MLS data, enables prospect tracking, generates branded picks pages, and facilitates communications between agents and prospects.
INFORMATION DEEMED RELIABLE BUT NOT GUARANTEED. Property data, including availability, pricing, square footage, zoning, and descriptions, is sourced from third-party MLS providers and listing agents. LowRenta does NOT independently verify this information. You are responsible for independently verifying any property information before relying on it.
EQUAL HOUSING OPPORTUNITY. LowRenta complies with the Federal Fair Housing Act (42 U.S.C. 3601-3619) and the Americans with Disabilities Act. It is illegal to discriminate based on race, color, religion, national origin, sex, familial status, handicap, or any other protected class. All listings are available to all qualified individuals.
Property data is provided by the Miami Association of REALTORS® and other participating MLS organizations. This data is intended solely for the consumer's personal, non-commercial use. Redistribution, retransmission, or republication of this data, in whole or in part, is prohibited except with express written consent.
LowRenta is NOT a real estate broker, agent, or party to any real estate transaction. We provide a software platform only. All real estate transactions, commissions, negotiations, and showings are between licensed agents, buyers, sellers, landlords, and tenants directly. Agents using LowRenta Pro are independent professionals responsible for their own licensing, compliance, and client relationships.
THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, whether express or implied, including but not limited to warranties of merchantability, fitness for a particular purpose, or non-infringement.
NO WARRANTY: We do not warrant that the Service will be uninterrupted, error-free, secure, or that property data will be accurate, complete, or current.
LIMITATION OF LIABILITY: To the maximum extent permitted by law, LowRenta's total liability for any claim arising out of or relating to these Terms or the Service shall not exceed the greater of (a) $100 or (b) the amount you paid us in the 12 months preceding the claim. In no event shall we be liable for indirect, incidental, consequential, special, or punitive damages (including lost profits, lost clients, or lost data).
You agree to indemnify and hold harmless LowRenta, its officers, directors, employees, and affiliates from any claims, damages, losses, or expenses (including reasonable attorney's fees) arising from: (a) your use of the Service; (b) your violation of these Terms; (c) your violation of any third-party rights; (d) any real estate transaction or communication you conduct through the Service.
The Service, including all software, designs, text, graphics, and logos, is owned by LowRenta or its licensors and protected by copyright, trademark, and other laws. You may not copy, modify, reverse engineer, or create derivative works without our express written permission.
The Service integrates with third-party services (Stripe for payments, Google Maps, Twilio for SMS, Resend for email, Meta/Facebook APIs). Your use of these services is subject to their respective terms. We are not responsible for third-party service outages or errors.
You may cancel your account at any time through your dashboard or by contacting us. We may terminate or suspend your account for violations of these Terms, fraud, or at our discretion. Upon termination, your access ceases immediately. Data retention post-termination follows our Privacy Policy.
We may update these Terms periodically. Material changes will be notified via email or dashboard notice 30 days before taking effect. Continued use after changes constitutes acceptance.
These Terms are governed by the laws of the State of Florida, USA, without regard to conflict of law principles. Any disputes shall be resolved in the state or federal courts located in Miami-Dade County, Florida. You waive any objection to venue. You agree that any dispute will be resolved on an individual basis only, and class action claims are waived to the maximum extent permitted by law.
